Terms of service

What SendTheStuff is

SendTheStuff sends files. You upload files and get a link to share, or we email the link to people you name. Recipients download without an account.

A transfer's link works for 14 days, and then its files are deleted. SendTheStuff is for sending files, not storing them, so keep your own copies.

Who can use it

• You must be at least 13 years old. If you're under 18, you need a parent's or guardian's permission.
• You can't use SendTheStuff if we've blocked you, or if the law bars you from using it.

Your account

• Signing in: we email you a six-digit code. A code works for 10 minutes and allows 5 wrong tries.
• Sign-in limits: up to 5 codes per email address, and 20 per IP address, in any hour. A new code can be sent 60 seconds after the last one. For IPv6, an IP address means a /64 network, and each /48 range can get up to 40 codes an hour.
• Staying signed in: you stay signed in on a browser for 30 days after you last use SendTheStuff there.
• Your account is your email address. Anyone who can read your email can sign in as you, so keep your email secure.
• You're responsible for the transfers sent from your account.

Limits

Transfers have these limits:

• Up to 5 GB per transfer, and up to 1,000 files per transfer.
• Up to 10 transfers, or 20 GB in total, in any 30 days, whichever comes first. A transfer counts once its upload finishes. When you start a new upload, uploads still in progress count toward both limits too.
• Up to 3 unfinished uploads at a time. An unfinished upload can resume within 3 days of starting. After that, it's deleted.
• Email transfers go to up to 10 recipients each, and up to 50 recipients in any 24 hours.
• Each file can be downloaded up to 1,000 times. We count this in bytes: a file can send 1,000 times its size in total. Partial and resumed downloads count about what they receive, not the whole file. Playing a video in the browser counts too.
• Free transfers are for personal, non-commercial use.

Other limits, on things like new accounts and reports, protect the service from abuse. When you reach one, the message says which limit it is and when you can try again. If we change a limit, we update this page.

Your files

• You keep your rights to the files you send.
• Your permission to us. You let us store, copy, scan, preview and deliver your files. You also let us show their names, your title and your message to the people you send them to. We use this permission only to run SendTheStuff, keep it safe and meet our legal duties. Those include preserving and reporting material, as our Privacy Policy describes.
• Your promise to us. You have the right to send the files, and sending them doesn't break the law or our Acceptable Use Policy.
• Anyone who has a link can download its files until the link expires or you delete the transfer. Share links only with the people you mean to.
• We don't review files. Our automatic scanning is described in our Privacy Policy. It can miss things. A file that passed a scan isn't guaranteed to be safe.
• Deletion is final. Files are deleted on the schedule in our Privacy Policy. We don't back up files, and deleted files can't be recovered.

If you receive files

• Files come from the sender, not from us. Only open files from people you trust.
• Files that can run on a computer, and files we couldn't fully scan, show: "Only open this if you trust the sender."
• To report a transfer, use "Report abuse" on its download page.

Acceptable use

You must follow our Acceptable Use Policy. It bans, among other things, child sexual abuse material, malware, phishing, spam and copyright infringement. It also says what happens automatically when a transfer is flagged, and how to report abuse.

Copyright

We respond to copyright notices under the Digital Millennium Copyright Act. When a valid notice arrives, we take the link down and delete its files. An account with 2 upheld notices within a rolling 12 months is blocked. Our Copyright Policy says how to send a notice or a counter-notice.

Suspension and termination

• Automatic action. We suspend transfers and block accounts automatically, as our Acceptable Use Policy describes.
• Other breaches. We may also remove transfers or block accounts when we reasonably believe you've broken these Terms, our Acceptable Use Policy or the law.
• What a block means. A blocked account can't sign in or send files. The block also covers the same email address written differently, such as with a "+tag".
• Child sexual abuse material. An account blocked for it stays blocked. We don't explain the block or discuss it.
• Appeals. For any other block, write to support@sendthestuff.com. We decide appeals from records such as account age, account history and what was detected, never by opening files.
• Leaving. You can stop using SendTheStuff at any time, and delete your account while signed in. Its transfers are deleted within a day.
• Changes to the service. We may change SendTheStuff, or stop offering it.

Disclaimers

SendTheStuff is provided "as is" and "as available". To the extent the law allows, we make no warranties of any kind, express or implied. That includes warranties of merchantability, fitness for a particular purpose and non-infringement.

We don't promise that SendTheStuff will always be available, or that every upload, download or email will succeed. We don't promise that files are free of viruses or other harmful content.

Limitation of liability

To the extent the law allows:

• We aren't liable for any indirect, incidental, special, consequential or punitive damages, or for lost data, profits or revenue.
• Our total liability for all claims about SendTheStuff is capped at the greater of US$50 and what you paid us in the prior 12 months.

Some places don't allow these limits, so they may not apply to you.

Indemnity

If someone makes a claim against us because of files you sent, or because you broke these Terms, you'll cover our reasonable costs. That includes legal fees, to the extent the law allows.

Governing law and disputes

These Terms are governed by the laws of the State of California, without regard to its conflict-of-law rules. Any dispute about SendTheStuff goes to the state or federal courts in San Luis Obispo County, California, and you and we agree to their jurisdiction.

Changes to these Terms

When we change these Terms, we post the new version here and update the date at the top. If you keep using SendTheStuff after a change, the new Terms apply to you.

General

• If a court finds part of these Terms unenforceable, the rest still applies.
• If we don't enforce a part of these Terms, we haven't waived it.
• These Terms, with the policies they link to, are the whole agreement between you and us about SendTheStuff.
• You can't transfer your rights under these Terms. We can, if SendTheStuff is sold or merged.
